Terms of Service

Last updated: 2026-06-20

Last updated: 2026-06-20. These Terms of Service govern your use of the OUTMARIN store (the “Site”) and any beats, bitpacks, drum kits and other digital products you buy from it. OUTMARIN is operated by IP HLYNOVSKII (“OUTMARIN”, “we”, “us”). Please read these terms together with the License Agreement, Free Demo Terms, Refund Policy, Privacy Policy and Cookie Policy, which are incorporated here by reference. This text is a content draft and is not legal advice.

1. Definitions

“Beat” / “instrumental” - an original musical composition and sound recording produced by OUTMARIN, sold under a license.

“Bitpack” / “pack” - a curated collection of multiple beats (a mini-album, e.g. “Digital Flowers”) sold together under a single license.

“Drum kit” / “kit” - a downloadable collection of original OUTMARIN sounds (such as one-shots, loops and samples) sold as a product and licensed for use in your own music productions.

“Exclusive” - an offer-based purchase (from $5,000) that removes a beat from sale and transfers exclusive rights under an individual agreement; it may also cover a beat made from scratch on commission, the project (FLP) files, and the producer’s involvement in the track.

“Free demo” - a tagged or watermarked public preview MP3 provided for evaluation only; it is not a purchase and not a license (see the Free Demo Terms).

“Deliverables” - the files you receive after a paid purchase (MP3, and, by tier, WAV and track-out), together with the license agreement.

“License” - the rights granted to you, described on the License page and fixed in the agreement delivered with your specific purchase.

2. Acceptance of these terms

By accessing the Site, browsing the catalog, listening to previews, downloading a free demo, or making a purchase, you confirm that you have read, understood and agree to be bound by these terms and the documents referenced in them.

If you do not agree, do not use the Site or buy from it.

You must be old enough to enter into a binding contract in your country of residence, or have the consent of a parent or legal guardian, to make a purchase.

3. Accounts and guest checkout

An account is not required to buy. You may check out as a guest using your e-mail address; your purchase and its license are then tied to that e-mail.

You can later create an account and attach (“claim”) prior guest purchases to it using the same e-mail. Once claimed, purchases remain available in your library.

You are responsible for keeping your e-mail and any account credentials accurate and secure, and for all activity that takes place under your account.

We may suspend or close an account, or refuse or cancel an order, where we reasonably suspect fraud, abuse, chargeback abuse, or a breach of these terms.

4. Products and previews

OUTMARIN sells digital products only - there are no physical goods and nothing is shipped. Typical products are individual beats, bitpacks, drum kits and exclusive rights.

Player previews and free demos are provided for evaluation and rough work only. They may carry an audible watermark (voice tag and/or sweep) and are NOT a license.

Previews and free demos may not be used in any released, published, broadcast, monetized or otherwise commercial work. Only a paid license grants the right to use an instrumental in a release. See the Free Demo Terms for the full rules.

Public catalog information (category, mood, preview audio, cover art) is provided for convenience; private details such as genre tags, internal dates and file paths are not part of the offer.

5. Orders, pricing and payment

Prices are shown on each product page in US dollars and are set solely by OUTMARIN. As a guide, the standard non-exclusive license for an individual beat is around $100, bitpacks are priced per release (for example, the “Digital Flowers” pack at $500), and exclusive rights start from $5,000 under an individual agreement. The price shown at checkout for your specific product governs.

Payments are processed by Lemon Squeezy, which acts as our Merchant of Record and authorized reseller. Your contract of sale for payment purposes is concluded through Lemon Squeezy, and their checkout terms and privacy notice also apply to the payment.

We do not see or store your full card details. Card and payment data are handled by Lemon Squeezy and their payment processors.

Taxes (such as VAT or sales tax) may be calculated and collected by Lemon Squeezy at checkout based on your location.

An order is only confirmed once payment has been verified on our backend via the payment provider’s signed webhook. Being redirected back to the Site after paying is NOT, by itself, proof of payment, an order confirmation, or a grant of access.

6. Delivery of files

Deliverables are unlocked only after payment is confirmed on our backend. Confirmation and a download link are normally provided to the e-mail you used at checkout and in your library if you have an account.

Paid and private files are stored in a private bucket and delivered exclusively through short-lived signed download links. There are no permanent public links to paid files; a signed link expires and can be re-issued from your library or by contacting support.

It is your responsibility to download and back up your Deliverables promptly after purchase. We aim to keep purchases available for re-download, but you should not rely on the Site as your only copy.

If a download link has expired, contact us at [email protected] from the order e-mail and we will re-issue access.

7. Licenses and rights

What you buy is a license to use the beat, not ownership of the underlying composition or sound recording. Standard licenses are non-exclusive: the same beat may be licensed to other artists. Exclusive purchases remove the beat from sale.

A standard license is a one-time purchase: no ongoing royalty is owed to OUTMARIN for the releases you make under it, and your paid files are clean and untagged.

For beats there are only two license types - the standard non-exclusive license and the exclusive. A bitpack is the standard license applied to a bundle of beats, not a separate type.

Drum kits are a separate product. The sounds in a kit are licensed for use in your own music productions, royalty-free within the license. You may not resell, share or redistribute a kit, or its individual sounds, as a standalone sound pack.

By tier, Deliverables generally include: MP3 for the most basic access, and additionally WAV and track-out for higher tiers and exclusives, together with a license agreement.

The full permitted and prohibited uses, credit requirement, term and territory are set out on the License page and in the agreement delivered with your purchase. Where this summary and that agreement differ, the delivered agreement governs.

8. Acceptable use and prohibited conduct

You may not resell, sub-license, lease, lend, share, transfer or redistribute the files or the license to any third party except as expressly permitted by your license.

You may not register an OUTMARIN instrumental (in whole or as an unaltered element) with Content ID, AdRev or any similar content-claiming or monetization-fingerprinting system.

You may not distribute the instrumental on its own as a standalone product - for example as a sample, loop, acapella, MIDI, preset or stem pack.

You may not claim authorship of the underlying composition, remove or obscure watermarks from previews or demos, or use the products in unlawful, hateful, defamatory or infringing content.

You may not attempt to circumvent the Site’s access controls, scrape the catalog, or access files you have not paid for.

9. Credit requirement

Unless your specific agreement states otherwise, every release that uses an OUTMARIN beat must credit the producer as “prod. OUTMARIN” in the track description or release metadata (for example the credits / producer field), so anyone opening the release sees that it was produced by OUTMARIN.

Do not place the credit in the track title - the song title stays clean. The credit belongs in the description or metadata, not in the name of the track.

The exact required credit format for your purchase is stated in your license agreement and prevails over this general rule.

10. Intellectual property

OUTMARIN, its name, logo, cover art, brand assets, site design and the catalog as a whole are the property of OUTMARIN and are protected by intellectual-property laws. Buying a license does not grant any rights to these brand assets.

All rights not expressly granted to you in your license are reserved by OUTMARIN.

11. Refunds and chargebacks

Beats, packs and kits are digital goods delivered instantly, and are generally final and non-refundable once delivered. Narrow exceptions (such as a duplicate charge or a file that was never delivered or is corrupt and cannot be fixed) are described in the Refund Policy.

Please contact support before initiating a chargeback - most issues are resolved faster directly. A chargeback on an already-delivered digital product may result in revocation of your license and access to the files, as set out in the Refund Policy.

12. Disclaimers and limitation of liability

The Site and products are provided “as is” and “as available”, without warranties of any kind except those that cannot be excluded under applicable law.

To the fullest extent permitted by law, OUTMARIN is not liable for indirect, incidental or consequential losses, lost profits or lost opportunities arising from your use of the products beyond the rights granted by your license.

Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud.

13. Changes to these terms

We may update these terms from time to time. The version in force is the one posted on this page with the most recent “Last updated” date.

Material changes take effect when posted; continuing to use the Site or buy products after that constitutes acceptance of the updated terms. Purchases already completed remain governed by the agreement delivered with them.

14. Governing law and contact

OUTMARIN is operated by IP HLYNOVSKII. These terms are intended to be governed by the laws applicable at OUTMARIN’s place of business, subject to any mandatory consumer protections in your country of residence.

For any question about these terms, your order or your license, contact [email protected] from the e-mail used for your purchase.
